House of Representatives Adopts Government Bill 02.23 on the Code of Civil Procedure

The House of Representatives adopted on Tuesday, July 23, 2024, by the majority of votes, Government Bill 02.23 on the Code of Civil Procedure. The adoption occurred during a legislative plenary sitting chaired by the Speaker of the House of Representatives, Hon. Rachid Talbi El Alami, and attended by the Minister of Justice, Mr. Abdellatif Ouahbi.  

The Bill reflects the High Royal Will expressed by His Majesty in his speech of August 20, 2009, on the anniversary of the Revolution of the King and the People, within the scope of instructing the Government to reform the justice system around six priority axes. The Bill also falls in line with the constitutional provisions regulating liberties and rights, and within the scope of implementing the recommendations of the National Charter for Justice Reform and the New Development Model. 

The Government Bill includes several legal novelties and core amendments within the format of a new comprehensive and integrated law that matches the international procedural legislative developments, in addition to the developments linked mainly to activating the positive role of judges in running cases, anchoring judicial efficiency, implementing the principle of jurisdictional unity, rationalizing the means for appeal, committing to the issuance and execution of sentences within reasonable deadlines, regulating international jurisdiction, defining the prerogatives entrusted to enforcement judges, implementing the principles of cyber litigation, digitalizing judicial procedures, regulating reconciliation and mediation, and embodying the independence of the judiciary. 

The Bill, including 644 articles, amended 440 articles, added 145 new ones, and integrated 45 articles that figured in other laws. The Government Bill on the Code of Civil Procedure would unify the civil, administrative, and commercial procedures, as well as those of proximity justice based on jurisdictional unity and specialization, as well as through the unprecedented legal definition of the provisions related to international jurisdiction and the use of modern technologies in litigation procedures to benefit from the fruits of the digital revolution and technological advancements.
