House of Representatives Adopts by Majority of Votes Government Organic Bill on Appointments to Senior Positions

The House of Representatives adopted by a majority of votes on Monday, November 22, 2021, Government Organic Bill 51.21 amending and supplementing Organic Law 02.12 on appointments to senior positions following Articles 49 and 92 of the Constitution. The adoption took place during a legislative plenary sitting chaired by Deputy Speaker of the House of Representatives Mohamed Joudar and attended by Minister in Charge of Digital Transition and Administration Reform Ghita Mezzour.

In her statement before the Representatives, Ms. Mezzour presented the amendments introduced to the organic law. In this respect, she noted, “The said amendments do not affect the law’s core but concern either the appendix that fixes the list of strategic institutions and enterprises, the appendix relating to the senior positions debated on during the Government Council, or both appendices." The Minister justified the amendments by saying that "the creation, reform or merger of some public institutions and enterprises dictates the update of the aforementioned lists."

The Minister added in her statement that the adopted Government organic bill “aims to amend and supplement the lists of public institutions and enterprises included in Appendices 1 and 2.” The amendments include the addition of some institutions to the list of strategic public institutions. The said institutions are the National Agency for the Regulation of Cannabis, the National Agency for the Strategic Management of State Contributions and Monitoring the Performance of Public Institutions and Enterprises and other institutions.

The Bill also sets out changing the name “Energy Investments Company” to “Energy Industry Company,” and the addition of some institutions to the list of public institutions included in Subparagraph “A” of Appendix 2 whose officials are appointed upon deliberation of the Government Council. The Bill also stipulates the omission of the “Marketing and Export Office” from the list of public institutions whose officials are appointed upon deliberation of the Government Council, following the promulgation of Law 06.20 enacting the dissolution and clearance of the Marketing and Export Office.
